Hi,
I know this has been discussed a lot but I need advise or suggestions..
I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....
My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
Please advise..

My labour was filed for a software engineer position (java, udb, etc) 3 years ago. Over that time, my role has changed to a project manager. Infact I don't do any coding anymore. If I invoke AC21 after 180 days, can I switch to a Project Manager position?

These are two different skills, unless you can manage to have job description of your new job to be the same as in LC. Or you can leave it the way it is, provided your employer intends to hire you as a software engineer upon approval of LC, and you intend to accept it. In the meantime, do whatever you want - project management or anything unrelated.

1) So does it mean, if we apply for fresh h1 and once it's approved, we can stay for 3 years initially irrespective of L1 stay, for my case its' 13 months ? If not, how L1 stay affects initial h1 approval timings ?
2) If I apply for h1, let say in June'10, and once it's approved what could/should be my joining date with new employer ?

As Silverlight is a browser side technology, you would have no problem serving Silverlight content from our servers as long as you add the proper MIME type settings to the site via .htaccess rules such as:
AddType application/xaml+xml .xaml
AddType application/x-silverlight-app .xap
AddType application/x-ms-xbap .xbap
HTTP responses have a "content-type" as apart of their header.

Get it Notarized with photo and send the document.There are standard formats available.
If it is Power of Attorney to deal in property matters on your behalf, then the notarized copy also needs to be stamped by the Indian Consulate in your area.
So there is one more loop involved - to get it endorsed by Indian Consulate, after you have done the notarization. I believe this is something that has become applicable recently as I had to do it last month. A few years ago when I had done the first one, it was just preparing the POA document, and getting it notarized.

The number of enforcement activities has increased dramatically in the past year. Now, more than ever, it�s important to insure that your company is ready in case of a government I-9 audit. And for the first time, it�s not enough to be in compliance. Each company must prove compliance, and if using an electronic system, use one that works in accordance with immigration laws.
The San Diego Union Tribune reports (http://signonsandiego.com/news/2010/oct/09/immigration-audits-are-increasing-against/), enforcement in San Diego County mirrors a national trend toward more scrutiny of employers� I-9 forms, the universal tool for verifying permission to work in the United States.
Immigration and Customs Enforcement, or ICE, initiated 66 audits with local employers in the fiscal year ending Sept. 30, reviewing 5,588 individual I-9s in the process. That was up from 44 audits in fiscal 2009 and just one audit in 2008. A company can be fined up to $1,100 for each illegal employee, and knowingly violating verification laws can lead to criminal charges and forfeited assets.
So the heat is now on employers to clean the house, it is also a great burden on employees to find work. As the illegal population continues to grow, they will also find creative ways to deal with the system. All we can suggest employers is to conduct routine internal I-9 audits and have an immigration policy in place, this is the best practice to follow.

Go to nearby embassy and inform about your situation. Make sure to keep all the documents and all also duplicate copy of your visa. Hopefully everything will be fine.

According to CIS ,they will take time upto 26th Oct ,just to issue the receipts. Again they say ,it might not be that longer but what I think we are not going to get the receipts anytime soon. At the same time we need not file another application if we dont hear anything from them till 15th of August,since we have the mail delivary proof that the application was accepted at TSC.
So there is no other alternative but to wait for either a receipt or checks getting cashed...

Also, say for I-485 the fee is 1000, does this fee include for spouse also? Or For spouse, the fee is extra $1000 ie the fee is per applicant or per family

I have applied for my extension of H1B at Vermont Center. my first three years on H1b expired on Sep 8th. The application was filed on July 20th and it is normal processing. I have my H1b and H4 receipts with me, but its not yet approved. I am planning to take B1 visa appointment for my mother. Shall i send my mother to B1 stamping with H1B receipt.
Does Chennai consulate will accept H1b receipt for Visitor Visa or Shall we wait for H1b Approval? thanks in Advance....

I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Whether it is LCA for H1 or PERM labor for GC it is location specific, unless one filed(or able to file) AC21 after July '07 fiasco, you need to have labor to a specific job to the specific location you will be working.
Either job or the location changes you need to start allover again, in some cases you can recapture (or port) your priority date.
